1. Agreement to Terms

By registering, deploying, or utilizing FaktoriBOT ("Service"), developed by Tajwar AI Lab / FaktoriBOT Technologies, your factory entity agrees to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company (such as a BGMEA or BKMEA member garment manufacturing enterprise), you represent that you have the authority to bind the entity.

2. Description of Service

FaktoriBOT provides operational monitoring, AI message classification, machine breakdown alert dispatching, standard operating procedure (SOP) vector indexing, and automated shift digests for garment manufacturing floor teams via WhatsApp integrations and associated web applications.

3. Authorized Group Participation & User Consent

When adding FaktoriBOT's automated number to WhatsApp operational groups:

• You affirm that the group is an authorized internal factory channel created for legitimate business and manufacturing communications.
• You affirm that participating supervisors, technicians, and floor operators have been informed that operational instructions sent to the group are processed for quality, maintenance, and safety purposes.
• FaktoriBOT adheres to a Silent Ingestion Protocol in group chats to preserve communication flow and avoid message spam.

4. Acceptable Use Policy

You agree not to use FaktoriBOT to:

• Transmit unlawful, abusive, defamatory, or fraudulent content.
• Attempt to reverse-engineer, decompile, or tamper with the underlying AI prompts, database structures, or proprietary classification pipelines.
• Violate Meta's WhatsApp Business Messaging Policies or Commerce Policies.

5. Intellectual Property & Factory Data Ownership

Your Data Remains Yours: All factory floor operational logs, machine parameters, defect records, and custom SOPs generated by your staff remain the exclusive intellectual property of your factory.

Platform IP: The software, AI prompt engineering architectures, vector indexing algorithms, and brand assets of FaktoriBOT remain the exclusive property of FaktoriBOT Technologies.

6. Service Availability & Disclaimer

While FaktoriBOT strives for 99.9% uptime, the service is provided on an "AS IS" and "AS AVAILABLE" basis. Operational alerts depend on underlying telecommunication networks and the Meta Cloud API infrastructure. FaktoriBOT should be used to assist and accelerate factory operations, not as a replacement for human safety and critical machinery shutdown procedures.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FaktoriBOT Technologies shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the platform.

8. Termination

Either party may terminate the subscription agreement at any time upon 30 days written notice. Upon termination, all customer operational message logs will be permanently deleted in accordance with our Data Retention & Deletion policies.

9. Governing Law

These terms are governed by the laws of the People's Republic of Bangladesh. Any dispute arising under these terms shall be subject to the jurisdiction of the courts of Dhaka, Bangladesh.
